Product Contact Point for Construction

To the basic provisions governing the matters concerning functioning of Product Contact Point for Construction belong:

  • Art. 10 of Regulation (EU) No 305/2011*;
  • Art. 9-11 of Regulation (WE) No 764/2008**

According to Regulation (EU) No 305/2011, in order to facilitate the free movement of goods, Product Contact Points for Construction, first of all provide information free of charge, on the provisions aimed
at fulfilling basic requirements for construction works applicable for the intended use of each construction product, within the territory of each Member State.

The duties of Product Contact Point for Construction in Poland  include:

  1. provision of information, using transparent and easily understandable terms, on the provisions,
    in force within the territory of Poland, aimed at fulfilling basic requirements for construction works applicable for the intended use of each construction product, as provided for in Art. 6(3) letter e
    of Regulation No (EU) No 305/2011;
  2. transmission (at the request of, among others, an economic operator or a competent authority of another Member State) of:

a) technical regulations applicable to a specific type of product within the territory of Poland,

b) information about whether a given product is subject to the requirement of prior authorisation under Polish law, together with information on the principle of mutual recognition and
the application of Regulation No 764/2008, within the territory of Poland;

c) contact details of the competent authorities in Poland (including contact details of the staff of
the authorities responsible for supervising the implementation of the given technical regulations within the territory of that Member State);

d) information on means of redress public available within the territory of Poland in the event of
a dispute between the competent authorities and economic operators.

 

However, the tasks of Product Contact Point for Construction do not include in particular:

  1. interpretation of the provisions of Regulation (EU) No 305/2011, Act on construction products*** and other regulations concerning construction products (for this scope, Construction Product Department shall provide information);
  2. providing press information (for this scope the Spokesperson for the GOBC shall provide information);
  3. providing administrative and legal  advice (e.g. assessment of the manufacturer’s documents or of the performance of a particular product, as it is the manufacturer, importer or seller must decide whether the product to be placed on the market or made available has certain requirements).

Responses shall be given 15 working days of receipt of the request.

Product Contact Point for Construction does not charge any fees for providing information.

On the GOBC website there is a list of regulations on technical requirements, currently in force in Poland, which contain technical provisions.

The European Commission publishes information on its website in the scope of the provisions concerning construction products. On this website there are among others EC answers to frequently asked questions. Information are in English.

The European Commission has published and is updating on its website the list of Product Contact Points for Construction, in all Member States. Information are in English.

There is a Product Contact Point in the Ministry of Development whose task is to provide information at the request of an economic operator or a competent authority Member State in the scope among others: Polish technical provisions relating to non-harmonized products and requirement to obtain an appropriate authorisation to place a particular product on the Polish market.

  2. In matters concerning your personal data, please contact the Data Protection Inspector by sending
    an e-mail to iodatgunb [dot] gov [dot] pl  or through the ePUAP box of the General Office of Building Control/ GUNB/skrytka.
  3. Personal data will be processed on the basis of Art. 6(1) letter c ofGDPR and of provisions of Act of 16 April 2004 on construction products (published in the Journal of Laws 2020, item 215)
    in order to perform statutory tasks.
  4. Your personal data will not be transferred to other recipients.
  5. Your personal data will be kept for a period of 10 years from the transfer of files to the Office archive.
  6. You have the right to access and rectify your personal data.
  7. You have the right to lodge a complaint with the President of the Personal Data Protection Office.
